The Process of Evicting a Tenant
Being a landlord comes with many essential responsibilities and procedures; however, these procedures can often be challenging to understand as they contain many requirements. The most common and unpleasant problem is often an eviction. While in an ideal world, every tenant follows the guidelines of their lease, that is typically not the case, and it is vital to have an attorney ready in the case an eviction occurs.
The first step of evicting a tenant is creating and serving an eviction notice. The three main types of notices are five, ten, and thirty days. A five-day notice is given strictly if a tenant has not paid their rent, a 10-day notice is given if a tenant has violated a lease term, and a 30-day notice can be given for any reason to end a yearly lease. One of these notices may be served, or all three. Landlord Evictions, LLC understands the proper use of each notice and the correct way to help them ensure a smooth process if the case goes to court.
If the tenant does not pay their rent or does not voluntarily leave the premises following the notice, a landlord will need to file a complaint. A complaint is a written lawsuit that describes the eviction issue, the terms of the lease, and how and when the landlord (or agent) served the proper eviction papers to the tenant. In a lawsuit for forceful entrance and detention, damages include (but are not limited to): past due rent, late fees, court expenses and fees for serving legal documents, and other legal costs.
Following a complaint, a landlord may obtain an order of possession. An order of possession informs the tenant of their window of time to vacate the premises, which typically allows a maximum 14-day possession to stay. However, if a tenant still refuses to leave the premises after the time laid out in the order, a landlord may begin the process of forcefully evicting the tenant.
The previously stated procedures only begin to skim the surface of legally evicting a tenant. It is often too complicated for a landlord to properly handle an eviction independently, considering the many other things they may need to tend to. The attorneys at Landlord Evictions, LLC have an exceptional amount of experience in handling eviction cases. They will ensure that your case is handled with ease and promptly.
Estate Planning
Rental property owners need to plan their estates. Failing to plan an estate may result in extensive and costly probate court cases. These difficulties can be avoided by preparing your estate with an experienced attorney.
A living trust is an estate planning strategy that states how a person will divide their assets if they pass away or become incapacitated. The probate court can be avoided by drafting a living trust, unlike a will. Overall, a living trust will result in far fewer issues and will be less costly long-term than a will.
Owners of rental properties should also consider protecting their assets by forming Land Trusts and LLCs. Combining the LLC and the land trust will lower your liability concerns while maximizing your asset protection.
Real Estate Closings
Whether you are a landlord looking to sell your property, or someone looking into expanding their ownership, Landlord Evictions, LLC can assist with all your Real Estate Closing needs. The attorneys at Landlord Evictions, LLC have handled many closings over the years and have the proper experience to make the selling/purchasing process easy and painless.
Asset Protection
Asset Protection is essential for landlords to protect assets from creditor claims. Attorneys specializing in estate planning may need to be made aware of title and real estate concerns, so hiring an attorney specializing in asset protection is essential. Peace of Mind Asset Protection, a division of Gateville, thoroughly understands the modes of asset protection such as LLCs, Land Trusts, etc. In addition, Landlord Evictions, LLC established the specialty of Real Estate Legacy Law to fill the gap between real estate and estate planning attorneys.
